If he still doesn't respond...I dunno what else to do. Try waiting for a few more days to see if he responds.

You can't really flat out declare you've won without a deadline, since that's why they exist. You should probably give it much more time, because having no deadline and thinking you deserve the win due to you thinking he's taking too long is rather unfair.

To be fair, we have no discuss a deadline. But it has been two weeks, Almost three, Since he told me he wanted to battle.
I don't know what to do. I don't want to win by default. If I do I will not be proud of that win.
