Yeah I've been letting it slide in some cases mostly because it's usually arguable whether or not it would apply to the topic, and people get really uppity about it when I give the infractions for it, but Scooty barely contributes anything worthwhile to the forum, choosing instead to frequently recycle the same age-old clapping gif, so in this case I did give him an infraction.
